Court rules AI agents can shop on behalf of consumers

A US Court of Appeals has ruled that AI agents are permitted to search online stores and make purchases on behalf of users, despite objections from tech giants.

A US federal appeals court has ruled that Perplexity AI can continue using Amazon’s website with its AI shopping agents to shop on behalf of consumers. Amazon had attempted to block legal access for these automated assistants. However, the court ruled that an AI agent acting at the explicit request of a user is legally equivalent to the user themselves.

This ruling marks a major legal turning point in the world of e-commerce and search technology.

Why this matters for e-commerce

Until now, major platforms and online stores could block automated bots relatively easily. The ruling demonstrates that blocking AI assistants is no longer simply permitted when these assistants act as a direct extension of the consumer.

For SME business owners running an online shop, this changes how customers discover products. Consumers are increasingly skipping visiting your website directly to search, compare, or order, leaving it instead to an AI agent. This smart assistant scans multiple online stores within seconds, compares specifications, checks stock levels, and can complete the order.

What does this mean for you?

When AI agents take over the shopping process, it is not just about how attractive your website looks to human visitors, but above all how easily understandable your data is for software.

Here is how to prepare your online store for AI shopping agents:

  • Use structured data (Schema.org): Ensure prices, stock status, delivery costs, and product attributes are technically flawless within your code.
  • Transparent pricing: AI agents drop out when faced with hidden fees at checkout or unclear terms and conditions.
  • Optimise for AI search (GEO): Ensure product descriptions are factual and clear, so an AI knows precisely when your product is the best match.
  • Accessible checkout: Ensure your ordering process can be completed without complex navigation barriers.

Shopping behaviour is steadily shifting from direct human visits to automated interaction. Online retailers that have their product data meticulously organised will reap the initial rewards here.
